mistake mee vayipu koodaa kaadu.. mee vaipeeee vundi. H4 is your own(beneficiary owns H4) not like H1(which is being owned by the employer). We have to apply H4, Attorney or Employer are doing just courticy to apply for your family along with your H1. ALWAYS make sure that you get H4 receipts to your home if not, escalate it. | ||

I think for short period ,it should not be a issue for over statying. The easiest and fastest way is to get out of the country and re-enter But the problem is they don't have valid visas to come back and can not exit once extension has been filed (as the application may be may be treated as abandoned) Contact a good attorney who can handle and advise | ||

Usually overstay of such small period is not treated as a big issue and will be excused....Surely they will question this during her next stamping, but as long as you can convince its attorney's mistake you can get over this...important thing is, ask your wife and kid to leave the country asap...more the over stay, more serious is the offense... mistake mee side kooda undhi, u did not do proper followup with Attorney...whenever attorney files for extension, we need to followup with him and get receipt numbers for all the cases (for you and each dependent)...H4 ki separate receipt number isthaaru though it gets processed along with H1...manam close gaa track cheyyakapothe bokka padedhi manake.. | ||

Please help what I can do in my case My H1b expired on 14-Jun and I got the extension approved. The stupid attorney completely forgot to send the application of extension of stay for my family and today he informed me about it. He asked me to go to CBP office at Chicago airport to extend the i94 for 4 more days so that they can apply for extension of stay for my family. CBP officer didn't even entertain my request and asked me to contact USCIS. For example if my family leaves now to India for stamping will there be any issues as they overstayed by 10 days. Please answer if you have any clue |
