Q: Is it true SPB cannot sing IR songs any more A: No, he can always sing as long as he has prior permission taken or royalty paid. Q: Why SPB says he can sing other music directors songs? A: He is acting smart, If he cannot sing one MD's songs, he cannot sing others without permission. The same copy right act applies to all music directors songs. Since IR has major share is fighting for everyone. ARR too has copyright for his songs. Q: Did IR sent notice to SPB? A: No. IR's legal counsel in USA, sent notice to organizers. Since SPB's son was one of the organizer, he took it to himself. Q: Why the notices served only in US, why not other countries, when SPB was touring many countries A: IR hired local lawyers everywhere, but in USA copy right is taken seriously, so the local lawyers took notice of the major event and served notices. It might be possible IR might not even know about this. Q: Why SPB took this as SPB vs IR issue. A: To get sympathy out of it. As usual when emotion plays than logic, people forget about actual issue and take sides to become judgmental. People blaming IR is complete non-sense. Q: Is it true as mentioned by SPB that he is not aware and ignorant? A: No. IR held a meeting with around 1000 performers in 2015 and discussed this issue. Same year he held press meeting and told everyone about the rules. He also filed a case when Echo company was trying to sell rights to other companies and he won the case to retain the music rights. SPB being in music field should be definitely aware of these happenings. Also paying to IPRS whenever there is a concert is going on for long time. Even lyricists, composers, producers are getting checks from IPRS for long time now. Q: Why IR is realizing about copy rights now not earlier. A: In 2015, he realized how #IPRS ( Indian Performing Rights Society.. ) is cheating all music directors, he took up the cause to fight for every one. #IPRS collects around 85 crores but paid IR only 13 lakhs in an year. Lakshman-Shruthi were the mediators between IR and other singing troupes in Tamilnadu. Since then he is representing the music directors and fighting for them. His idea is to streamline the process. Q. What is current Indian copy Right law for movie music A: The current copy right act gives producer/music company 50%, Music director 25% and lyricist 25%, however if Music director gets the right as well then he gets 75%. ARR in 2012 got it amended to get music director the right instead of Producer after 5 years of movie released. Q: Does it mean no one can sing any song in public? A: No, unless there is huge commercial gain out of it, there is no issue in singing song at any place. Music directors wont claim if one is singing in temples or non-commercial purpose or for review, analysis, teaching, research or even minute commercial gains are fine. Q: Are singers included in copy right act? A: No, Unfortunately, singers are not. This was in discussion during Rafi/Lata times. Rafi didnt want it but Lata wanted singers to be included, even Yesudas too didnt want the royalt. Also many other singers formed a group and fought, None of them were successful in amending the law which enables the singers to get royalty. Q: Is it applicable only in South/Tamil? A: No, some music directors like #ARR are very clear on these rights. They have clear contracts which gives them rights. Same is with #Shankar-Ehsaan-Loy. In stage shows, they sing their own songs. Also these directors can use same tunes in other languages. Q: What will happen next. A: The awareness that Indian music directors should get the royalty has caught everyone's attention. Thanks to SPB. Now, music directors will get money at-least. Probably IPRS will be taken over by some other society or Government will intervene to form a different society. Last 10 years, have seen huge increase in using Raja's music in films and TV without his permission/legal cut. If the movie/tv/radio companies gave their share, Raja would be a millionaire. They want to make money but won't pay Raja? Whereas all these people pay A.R.Rahman his share. It's sad that people thing they can take Raja for a ride. I was upset about the whole issue, involving legends. But SPB never mixes friendship and business. Not sure why he is doing that now. Raaja had made public meetings two years back it seems, regarding rights. But people chose to ignore him. | ||
