No, you have to make an exit and entry back to US. There are only two ways to get I-94 extended on passport renewal as confirmed by CBP.. 1. Make an exit and entry, 2. Apply for H1 Extension. I94 topic kabatti..i want to know what to in this case: first time US vachinappudu i94 was issued till the date of my passport expiry, even though I797 was valid for 3 more years. I got my Indian passport renewed now. Should I make a trip out of the country with new passport and come back, to get new i94 as per the i797 date? | ||

I have also seen a reverse case, one of my colleague got 1 year more on the I-94 than what is mentioned in the i-797...and then we reached out to our office attorney, he said she can stay as long as I-94 is valid also the company was not willing to apply for H1 extension though I-797 expired stating that you still have 1 more year valid on I-94...the problem here is, she is stuck in the country for one year and cannot go to india...so with a reason that she needs to go out of country, company had to file the extension out of force.. | ||

yup... but this is also highly contentious and is on case by case basis it varies...I had a couple of friends and my cousin who tried this apporach and failed in Newark/JFK...its up to the CBP to accept it as a mistake and correct it or not...Attorney ni contact chesthey they asked to apply for a H1 extension because the I-94 date is close to I-797 expiry date or get out of country and come back...anyway it might be worth to give a try at the CBP office, but I have seen hundreds of threads on Murthy with same issue and CBP rejected the correction | ||

follow the i94 correction process you have both visa and h1b 797 expiring after i94 there are many correction centers...it should not take more than an hour for in person correction ppl do it a lot | ||

Hi, I went to stamping in 2014 and I had my H1b still 2017 and when I stepped back to the country my I94 date and Visa date is same. In 2015 I have changed my job and applied for h1b amendment, My h1b amendment was approved and extended until 2018. Again I went out of the country and came back my I94 is same as before. they have not extended my I-94 still my visa 2018. so, my I-94 is going to expire in a couple of months so what can i do to renew my I-94. | ||

One need go out of country to get it corrected, only if its not a mistake. If its a mistake on CBP like in this case, then we can go to any international airport CBP office or local CBP office and get it corrected. Winner Audio review | ||

not true i got i94 corrected (adjusted to date on 797 which I prensented at PoE) more than once no need to go out, even if visa expired cbp officer told me - already valid visa meedha lopalki vassav ...bayataki velli yemi chesthaav...you still have a valid 797 | ||

I-94 date takes precedence over any other date...Visa stamping date, I-797 date veetannitni I-94 date over ride chesthundi...so he needs to apply for extension like a regular H1 extension...only other option is, he can step out of country and get back in expecting that he will get a new I-94 with the date same as I-797 date... oka saari mee friend ni passport expiry date check cheskomanadi...bcos in many cases I saw that they give I-94/stamping date only till Passport expiry but not till the end of I-797 bcos Passport expires before I-797 expiry date.. | ||
