Wait for 6 months and then move...if your old employer revokes 140 and your new employer is not able to get a new perm and new 140 before the new h1 period ends then u r in soup..after 6 months its all yours, u get unlimited number of extensions on h1 even if your new employer does not apply for your gc

once I140 is approved that date is urs it doesn't matter when the old employer withdraws application or not

you will get 3 yr extension when u transfer and when u apply I140 at new emp u can port the date

Under another provision in the proposed regulation, once an I-140 has been approved for 180 days or more, it could only be revoked by the USCIS based on error, fraud, or misrepresentation, or upon revocation or invalidation of the corresponding labor certification. This means that, if a petitioner were to withdraw an I-140 180 days after its approval, this would not cause the USCIS to revoke the I-140. Such withdrawals are quite common in situations in which the I-140 beneficiary has moved to a new employer.

The continued validity of an approved I-140 under these circumstances would provide two notable benefits. First of all, an H1B worker could continue to use the I-140 as a basis to extend status beyond the six-year standard limit after a change of employer. In addition, the I-140 could continue to be used by a dependent spouse to qualify for an H-4 EAD. As long as an approved I-140 remains valid, it may be used by any employer as a basis to request an extension of H1B status beyond the standard 6-year maximum. But, the I-140 must remain valid until the H1B is approved. Once an I-140 is withdrawn by the petitioner, it may no longer be used to request an H1B extension of status. If the I-140 is withdrawn after an H1B extension is granted, the USCIS has issued guidance that it will honor the H1B approval for the entire validity period.
