NJ lo rule H-1B visa holders are authorized to work in the United States for one specific employer. If you are permanently separated from that employer and your alien status has not changed, you cannot legally work for another employer and you would be ineligible for benefits. According to the Department of Labor, you need to meet two criteria to qualify for unemployment: You are unemployed through no fault of your own: That means you are out of a job due to reasons beyond your control, like a layoff.
