If I were you, I would wait for 3 months before taking any decision. Right now there is lot of noise. In next 3 months we will get a clarity on how Mr T is going to wrt legal immigration. Once the direction is set, if there is a possibility of getting EAD or GC in next 1 year stay with ur employer. If not, move to FTE.

If your current employer co-operates and allows you to go back to him after dates are current, probably you can take it now.

For your case, the best bet for you is to ask your FTE company to file a brand new PERM under EB2, once approved, ask them to file i140(by using the existing i140 pd to pull it to the new i140.) once the new i140 approved, you can join them safely. But legally, you dont need to even join them till your actual final GC is approved. But once GC approved, you must join them and work for them for a reasonable time(min 6 months to any max).

While the above process is going on, you dont lose your current i140 (or any other i140, if any) all these are parallel processes(unless and otherwise there is a fraud on your side with respect to your criminal background, lie on your presented experience, your status maintenance etc).

As many other are taking here, its not required to be in the same or similar job (description, prevailing wages etc ) requirement if you have brand new PERM+i140 combo but all must be in the EB category to port the older PD across.

I did that i filled my EB3 under Java developer and then filled EB2 as a .NET developer. Both PERM and I-140 got approved yo need experience letters to support in I-140 as labor they do not see as there is no mention during labor processing about your previous skill sets.

New job requirement to be in the same or similar job category is required ONLY for AC21 cases(where there is no new PERM/i140 process but changing the jobs at the AOS level for the already approved i140 category.
Better do some more research in these lines.

On the other hand, you may not lose anything if the new GC process fails as your previous GC is still intact(provided your current i140 company cooperates with you if any RFE etc).

my GC has been filed with a designation and job duties that are totally different to what my role and skill set is right from the start.. and when my FTE company files for GC, they obviously will be filing my exact role, skill set and job duties.. so not sure if this will impact the porting of PD??

so if you go to FTE, how can you get the extension beyong 6th year ?




PD podu kada.. unless my current company chooses to revoke.. which is not possible with the recent rule.. i'm already past 6 years on H1.. new company can still file for H1 based on approved 140 from old company..

Seems you haven't filed 485 yet, better stick to current employer. 2010 PD ante inko 1 or 2 years lo you will have chance to file 485 atleast. FT teesukoni, malli labor and 140 ante takes time. Ippudunna situation maree worst. Seems every 140 getting rfe. And new company lo ee process ayye time lo nee date current ayite, you will miss chance.

Specify the month in pd 2010..
With the current pace I believe it takes at least 3-4 years to clear the existing backlog. I don't think they even move fa dates. if your new company pays high salary then it would be better to take the fte.

you are going to throw away your 2010 priority date .. you must be in 6'th year of H1
so if you go to FTE, how can you get the extension beyong 6th year ?

Can your current employer continue your GC, even if you go for a FTE ?

with this and everything else going on, what do u feel abt going for FTE overall in current conditions?

you can get fte later , wait until you get the EAD

if the FTE is gone , you will be in worse condition

Have an opportunity to go for FTE but have been confused for quite a while to take it.. only becoz of lack of clarity whether i'll be adversely impacting my GC process in future?.. have approved 140 with my current consulting company with PD in 2010..

Of course as per the recently enacted rule, we know we can preserve our PD but na case lo one of the big questions is if there is anything else that might make my PD invalid when it comes to the time for porting.. my GC has been filed with a designation and job duties that are totally different to what my role and skill set is right from the start.. and when my FTE company files for GC, they obviously will be filing my exact role, skill set and job duties.. so not sure if this will impact the porting of PD??

Any insights are greatly appreciated.. :-)
