what law guarantees that you have valid visa,a you can enter country. what unconstitutional. Imagine a guy got visa. later he found to have dubious connections to tellals. country bans him. jusge issues a TRO and gets him into country. who is at fault.  A TRO for anything else under the sun is ok like tpp, keystone pipelines but to give to foreign nationals entering usa is shameful act. now all people who had their visas rejected at consulates, at POE can file law suites in courts.  annitikante most aggregious move emitante washington and other state claimed undue hardships for denying entry for folks, why did judge lifted ban on new refugees entering. I am positive that in the end ac gaves ruling that president has the powers to do it. Only impact is some people with valid visas will get in. 2000 more refugees can get in till the issue is finalized. When security of country is at stake and issue is for non citizens, courts should side on the err of government. Baseless tirade I) what Judge issued was TRO - temporary restraining order. It's not even preliminary injunction. There are 3 different levels. TRO expires in 10 days itself and is issued in emergency. Injunction is issues till final ruling is given. Final ruling stays forever. 2) judge gave TRO. Next court refused to stay ban on TRO and wanted full briefings by Monday evening/ at which point it will decide outcome. Judge who gave this order supports black lives matter. What he did wrong was he did not even cite what part is unconstitutional. Very ridiculous way and extended his order to whole country when only 2 states are included in suit. Following are the issues in his ruling A) states said they are enduring undue hardship from EO and asked for temporary relief till a final determination is made. He agreed with them but provided relief for all other states. Who asked him for that? Who represented them? B) if he included which section of constitution the EO obstructs, there is very chance that it's gets overturned by next court if judge doesn't not believe enough evidence is there. So he kept vague so that the high courts have to have full briefing before making a decision thus making his stay longer Monday evening appalette court will say about it. 1) what if another federal judge says the ban stays on? Who will resolve the impasse? 2) as per constitution And law passed, the ability to refuse entry for non citizens is given to president for any or no reason. This ruling gives leeway for so many law suits I further 1) if you were denied enters at Poe, can your lawyer file in court that you will have undue hardship because of this action and judge grants TRO, he can get in. Then can apply for refusal of visa too.
