Ipc302:what if you move to a new company after 1-140 is approved and before the 180 day period....
As long as your I-140 doesn't get revoked for 180 days (even if you've moved to a new company) - I believe you are good...again, this is just my understanding. |

no need...based on the new regulations..that went live on Jan 17th 2017 you need a new PERM/140 only when your date is getting current and you need to file i-485 along with Supplement J, if you have moved on from your variginal employer who filed your first I-140 |

H1 and i140 both are being OWNED by Employer not Employee(you). All you are carrying with you is the eligibility to be employed by a (H1B)sponsoring US employer. Having said that. There is nothing in this world called H1B TRANSFER. 'n' number of US employers can file for your H1 petition at a same time but you must work for AT LEAST ONE EMPLOYER at any time to be on the H1 status. As I said, since i140 is being owned by your employer each time, it would be gone along with that employer. All you should do is to get the new i140 filed. It can be protected only if an i485 was filed and 180 days passed. Read more about AC21 clause. |
