As long as your I-140 doesn't get revoked for 180 days (even if you've moved to a new company) - I believe you are good...again, this is just my understanding. | ||

very good question ? still you can port 99% of the time unless employer explicits revokes it( less than 1% chance evo reasons cheppali then USCHESS void entire application) rather than simply intimating to USCIS saying employer is no longer with company --- this is old rule | ||

no need...based on the new regulations..that went live on Jan 17th 2017 you need a new PERM/140 only when your date is getting current and you need to file i-485 along with Supplement J, if you have moved on from your variginal employer who filed your first I-140 | ||

H1 and i140 both are being OWNED by Employer not Employee(you). All you are carrying with you is the eligibility to be employed by a (H1B)sponsoring US employer. Having said that. There is nothing in this world called H1B TRANSFER. 'n' number of US employers can file for your H1 petition at a same time but you must work for AT LEAST ONE EMPLOYER at any time to be on the H1 status. As I said, since i140 is being owned by your employer each time, it would be gone along with that employer. All you should do is to get the new i140 filed. It can be protected only if an i485 was filed and 180 days passed. Read more about AC21 clause. | ||

If your I-140 was approved more than 180 days ago -- you are good. Company B can file an H1B petition on your behalf - and request for a 3 year term. Similarly down the lane (as per your example) - say 6 months later -- Company C can file an H1B petition on your behalf - and request for a fresh 3 year term Both the above petitions by Company B & Company C -- will be based on your approved I-140 petition from Company A (As long as your I-140 from Company A doesn't get revoked for fraudulent reasons - you're good) This is how it works now (thanks to the new rule - even though it is a piece of crap otherwise, this is one of the good things in that rule) Please confirm this with a qualified attorney - before you take the plunge. | ||

Working for Company A since 2012 Aug H1 Extension expires in 2018 I-140 approved already If I join Company B and leave it in 6 months to join company C, what happens? How long will I get H1?
