Some points of interest :

The Hyderabad High Court has put a stay on the award of the contract, and fixed the next hearing for October 31

Aditya director B. Mallikarjuna Rao, filed a petition in the Hyderabad High Court, alleging that the CRDA had not disclosed the commercial bid in terms of the OPP's revenue share offer, making a mockery of the entire process.

Having got wind of the impending judicial roadblock on August 26, the AP government hastily directed CRDA to amend the bidding process and release more information to other bidders.

"We sensed all this was a sham at the first pre-bid meeting on August 8," says a representative of one of the prospective bidders on condition of anonymity.

"The government was not keen on anyone but the Singapore consortium, though there were seven interested parties, including two little-known Chinese companies. All questions and objections raised were brushed aside."

Justice M.S. Ramachandra Rao ruled that the consortium could not dictate the terms of the contract. He argued that India, as a sovereign country, had the right to ensure the laws of the land were followed and that the excuse of proprietary information cannot be accepted in issues relating to public works.

State contemplates giving irrevocable power of attorney to the consortium which implies that after awarding [of the contract] nothing can be retracted.

in the event of any disruption other than political reasons, the state will have to return the consortium's capital with 20 per cent interest.

If the disruption is political, AP will have to return one-and-a-half times the capital with 16 per cent interest.

"Moreover, land which can fetch Rs 20 crore an acre is being offered at a throwaway Rs 4 crore."
