this is for my BIL. he used to work here during 2009 time, because of bad market he went back to India. got an internal project onsite opportunity in IBM and want to apply for H1B ... immigration dept said this is not possible under cap exempt since he is out of US for more than 6 years and he needs to wait until april quota. question to experts ... Is this true or can we still apply under cap exempt? |
