Asalu Porting ki EB class ki sambandam lene ledu. there is NOTHING called PORTING. You had an EB class(EB3) petition pending for a given job(in Other words, you had a hot metal stamped on your yeass with the PD). Now you need to start a BRAND NEW labor all together which goes under EB2 class requirements. Once your labor is approved, while filing the new i140 for THIS labor, you have to add a copy of your OLD approved(EB3) labor copy and a covering letter requesting to attach your previous PD to the new i140 approval. Once you get the new EB2 i140 approved, they would stamp PD as the old labor PD. And at this point, you may not need to file another 485(if your EB3 485 was already filed). Make sure that you have got the same Alien number on both the old and new i140s. Once its there, all of your petitions were tied to the same file and your pending 485 uses the best option for you(the new EB2 i140 witht he old PD). | ||

yes - in that case we're not starting from scratch. That's when these restrictions will kick-in. But on the flipside - it'll take at least 2.5 to 3 years for the new company to start GC and for one to get to "I-140 approved" status - unless it's expedited. | ||

You're with company A - you've your Labor, I-140 approved and I-485 filed. You move to Company B - and invoke AC21 - that's when these SOC codes, etc. matter. I don't know specific details. But that's how it works. But your scenario doesn't seem to fall in that category | ||

As your going to start your GC afresh (only going to retain PD) - you can start with a brand new title with brand new responsibilities. As others said earlier - You'll be fine. Of course, caution: I'm not an immi attorney - please follow this advice as per you wish ;) | ||
