Atta boy, why dont u apply in premium with the FTE employer. 2 weeks lo 3 years approval vasthadi. Join ayinaka as usual perm and 140 clear cheyinchuko with porting old date. Old PD vachesthadi mostly. But get 140 in premium again unless edanna rule pass avthe in the next 3months. | ||

had a consultation with a big attorney and below are the answers...may be useful for any of you...anduke esthunna...first hand info...no freind's friend or cousin's wife's cousin's best friend's brother scenario.. a) h1b term ayipovasthundi...140 undi...ippud new company h1 file jesthe...enni years extension vastadi ? ans) 3 yrs..as you are using your 140 approval to file for h1b... now if you move company and your old 140 is withdrawn.. and when it is time to file for your next 3 years extension...you do not have your new 140 yet... then you may be in precarious situation.. b) old employer 140 revoke cheyotcha ?..what is the process ? ans) they can...very easy..they just have to mail youyesseeies c) if old employer withdraws I140...is it possible to port date.. ans) as long as 140 is not revoked for fraud...95% possible to port date..even if it is withdrawn.. d) any other things to be aware of while switching ? ans) do not move before your new h1b is approved...thus do not give a chance to old employer to withdraw 140 before h1b approval e) will any new rule help in cases like this.. ans) there is a rule coming up which says..if your 140 has been approved for 6 months, employers cannot withdraw it.. which shld help in cases like this.. f) any idea when it will come.. ans) nee talakay ra..nee talakay...naakemi telsu...last time perm rules change appudu proposal some 1999 lo vachina...final action loki came only in 2005..so we cannot say.. inka konni adiga...but out of context here..
