Yes, they will give total 3 years. Provide the i140 approved copy to new employer. Using this copy new employer can request the h1 extention beyond 6 years once it is approved then love to new company and start perm again

Simple question:


Approved (>6 months) I-140 from Emp 'A', now moving to Emp 'B'.

How will Emp 'B' file H1 transfer (assuming no 140 revoke/withdrawal)

1) Emp 'B' will File based on Emp 'A' approved I-140 - Fresh 3 year isthaada, based on approved 140 ani or whim and wish of Immi LK gaallu

2) Current rules tho, Emp 'B' ki transfer ayinappudu Emp A approved I40 lekkaloki teesukoru no matter when its approved and what state it is.

Pai condition lo 2 scenarios

a) H1 b 6 years, still time left to capture
b) H1 b 6 years ayipoyindhi, 140 approve ayyi > 6 months with Emp A, e basis medha H1 transfer avuthundhi ippudu, Perm or I40 or which one ? isthe enthaa timeframe ki isthaadu

Mayer Brown who servers amex told me, we can recapture your date if your i-140 is revoked..we did it in past ...there is no clear rule abt it anaadu :D

Detailed question:
I have PERM approved and I-140 filed in regular processing by my current employer "A". I have got an opportunity from employer "B" and then told they will process my GC as fresh application. I have 17 months left on my H-1B visa. <br> 1. In pending approval of I-140. will I get the extension of 3 years from USCIS when employer "B" initiate the transfer ? OR Will I get the H-1B transfer extension till max out ?<br> 2. Is it recommendable to switch now in between of pending approval process of I-140?<br> 3. Will leaving in between of pending process impact me in future when employer "B" files my GC once again ?


Answer:
Under the current laws, if you change jobs after I-140 approval you keep your priority date, but you lose your right to H-1 extensions beyond what is given if your old employer revokes/withdraws the I-140.

Now answering your questions

Answer 1.No, you will get an H-1B extension for the time remaining and you can actually claim one year extra if your PERM was filed more than a year ago. But you will get only three years if the I-140 is approved. Not if it is pending.

Answer 2. I don't recommend it. I think you should get your I-140 premiums, get it approved and then leave if you want to.

Answer 3. I don't think that is a major issue, but do talk to your lawyers. Hence it makes sense in my view not to change until the I-140 is approved.

Immihelp lo oka answer by attorney :

If the I140 is revoked, the worker will not be eligible H1B extensions based on the I140 approval.

If the approved I140 is withdrawn after an H1B extension is approved, the post-approval revocation should not negatively impact the H1B approval.

As far as keeping the priority date from the revoked I140, historically this has been possible when the I140 is revoked because the employer withdrew it.

However, there have been a number of examples when USCIS has refused to allow the transfer of the priority date.

This unusual position by USCIS can be challenged in federal court, but to this date it is not clear that anybody has tried to do so.

I am on H1b visa which expires (6 Years term ) on April 2017 ( 14 months remaining) , and have my 1-140 approved (EB3) with my current employer.

Scenario 1: I am planning to move to Company B and I have couple of questions as below,

Question 1:
Since I have 14 months remaining with my current ( 6 years term) H1B & Approved I-140, on which condition below I will get my visa period through Company B ?

Condition 1: I will just get 14 months extension from originalH1B ( from 6 years term )
Condition 2: I will get 3 years extension based on approved 1-140
Condition 3: I will get 14 months + 3 years extension using remaining month for original H1B & approved I-140

Question 2:
Company planned GC in EB2 category but only after a year of employment. Would my priority date be retained if Company A revokes my previous I140?

Scenario 2:
if I move to Company C within 6 months of joining Company B without the green card process being started in Company B, How many months of H1B visa will I get through Company C ?

3. If Company C agrees to do GC, can I retain the priority date from Company A even if Company A revoke the approved I140 and Company B didn't do anything with my GC?

Similar situation lo unna. Kakunte desi consulting oni daggara 140 cleared since 2012. He will not cancel 140. So anduke entha ullasanga unnanno utsahanga unnano till dates get current. 2nd fte theesukuntunna. In the last 5 years.

Same situation lo nenu unte.. unless employer is a sucker.. I would have done the H1 transfer everything and tell him before a week or 2 before I join.

Tell him that I need to join FT for my career.. I know its not in your interest so tell me how we can do this so it benefits both of us ..adu padho parako adigithe vaadi mohana kotti amicable ga settle chesukovatame..but it gives freeedom to pursue your career and what you want to do.. dabbu eeroju kakapothe repu earn cheyochu..

One more thing.. when you do this.. first step is H1 transfer , then you apply Labor and I-140 with new employer.. then I-485 when it becomes current.. even in case employer revokes I-140, only thing you loose is priority date ?

FT in a company prone to layoffs is a risk too.. check how soon they will file the Labor and I-140. Some FT companies have long waiting lines..get written HR confirmation..

I did convert to FT while consulting company was holding I-140.. my EB3 PD was stuck so took chance.. in my case I switched even FT..I changed from the first FT to a second FT which did the EB3 to EB2.

know lets say he takes FT offer...and consultancy employer withdraws 140....after 6 years h1 extension file chesepaatiki he may not have new perm or 140 kada....

can he use old withdrawn 140 to get 3 yrs extension or can he even use old perm ?
