as soon as F1 converted to H1, F1 was invalid and hence F2 was also invalid.

So, it is as if wife was out of status.

Now the tricky part here is she also lost F2 once F1 became H1... so ikkada she didnt have any particular status at all kaabatti above point ni use cheskoleru emo..

I don't think there is any option other than leaving country right away and entering back with a latest H4 Visa stamp....less than 10 days gap ante they might let go...but 3 months is a long time...and more period you are out of status, more the penalty(chances of denial of re-entry)...she can always explain during H4 stamping that the new employer missed filing her application and as soon as they were aware she took necessary steps to correct the status...

naa friend okadu ilaane F1 lo CPT 2 months ki theesukuni he worked for 3 months...he was automatically out of status as he worked illegally...and the college had to apply for a reinstatement for getting him out of status...after that he converted to H1, got stamped, filed GC etc etc...only issue is, he is flagged in the system for being Out of status and whenever he enters the country they take him to secondary verification and they ask why he was out of status etc and let him go...

employer tappu chesindu... any of the 3 immigration depts can deny her entry at any point of time... husband permanent set aithe probably she can be safe in future..

Licked..out of status..what happend after RFE..immediate ga country outside poyi H4 stamp veyinchukuni ravali...as soon as he knew H4 out of status

Person X is on F1 and Wife is on F2 intially
Got his H1 with Emp A on Oct 1 2015 .. Employer A didnt filed H4 for wife
Transferred H1 to Emp B and filed H4 for wife too on jan 29 2015

His H1 transfer was approved and got an RFE on H4

you are out of status from october 2014 to Jan 2015.. Please explain delay in filing etension ...blah blah blah


How serious is this ?
