DA case: Delhi HC asks Himachal CM to cooperate with CBI ANI | Apr 5, 2016, 04.15 PM IST . New Delhi, April 5 (ANI): The Delhi High Court on Tuesday asked Himachal Pradesh Chief Minister Virbhadra Singh, who is involved in a money laundering and disproportionate assets case, to cooperate with the Central Bureau of Investigation (c) so that the probe may conclude soon. The court also asked Singh to appear before the agency at the earliest. Earlier in the day, the CBI submitted in the court that the evidences against Singh are very crucial. Stating that the case is very serious, the CBI said the investigation is being hampered due to the stay granted by the Himachal Pradesh High Court. The Delhi High Court will resume the hearing in this case tomorrow. The Himachal Pradesh High Court had earlier passed an interim order, saying the CBI cannot interrogate, arrest or chargesheet Singh without its permission. The CBI has filed a plea in the Delhi High Court against this order. The Enforcement Directorate (ED) has attached some of the assets of the Chief Minister worth Rs. eight crores in connection with the money laundering case. On March 16, the Delhi High Court had refused to grant a stay on the proceedings initiated by the ED against him. The ED had last year registered a money laundering case against Singh and others under provisions of Prevention of Money Laundering Act (PMLA) after taking cognizance of a criminal complaint filed by the CBI in this regard. nov 6 2015 The Supreme Court on Thursday transferred the corruption case against Himachal Pradesh Chief Minister Virbhadra Singh and his wife to the Delhi High Court âto protect the institution from embarrassmentâ and also âto avoid further controversyâ. Seeking transfer of the case out of Himachal Pradesh, the CBI had alleged that the judge who had stopped the agency from arresting Virbhadra and his wife had been his lawyer earlier. A bench of Justices FMI Kalifulla and Uday U Lalit, however, chose to steer clear of this controversy and said the matter should be heard by the Delhi High Court âin the interest of justiceâ and to ensure that no further allegations are levelled against the court. âWe donât want any more allegations or counter-allegations. We are interested only in the institution. We donât want to give scope for any further controversy. In the interest of the institution, we think this matter should be transferred to the Delhi High Court. This should rule out any embarrassment to anybody,â said the bench. Appearing for the CM, senior advocate Kapil Sibal opposed the transfer, arguing that it would set a wrong precedent if a case is shifted only because of allegations against the judge. âWe have said it in our affidavit that the judge has never appeared as a lawyer for the gentleman (Virbhadra) or anybody in his family. Transferring the case would mean casting aspersions on the Himachal Pradesh High Court. It would mean there are no judges in the High Court who could hear this,â he added. But the bench clarified: âWe will have to protect the institution. We will have to transfer this case in order to ensure neither the image of the parties nor the image of the institution is sullied. If need be, we will use our power under Article 142 in the interest of the institution.â Under Article 142, the top court is empowered to issue any order for securing the ends of justice. As Sibal argued that all cases allegedly involving CMs of Chhattisgarh and Madhya Pradesh should also be transferred outside the states if this has to be the precedent, the Bench retorted: âIt all depends on the facts and circumstances of every case. We are not looking at preliminary issues. We are looking at larger issues and our only concern is the image of the institution. The Supreme Court on 1 March, 2007 directed the CBI to inquire into a PIL filed by Vishwanath Chaturvedi in November 2005, which sought an investigation into the allegedly huge amount of illegal wealth amassed by Mulayam Singh Yadav, his sons Akhilesh and daughter-in-law Dimple Yadav. The agency was asked to check if the allegations made by the petitioner were correct or not, conduct a preliminary inquiry and see if a case could be made for further action. The CBI had collected 350 documents and questioned eight persons to check the accumulation of assets by the family in the period between 1 April 1993 to 31 March 2005. The 10 page CBI status report said that in April 1993 Mulayam Singh had assets worth Rs 18,25,266 and bank deposits of Rs 164791. By March 2005, the value of his immovable assets worth jumped to Rs 45,928,037, while his movable assets in the form of bank balance, FDR investment, and jewelry etc was at Rs 29,334,853. The CBI is expected to plead that since Dimple Yadav, Mulayam's daughter-in-law was taken out of the probe ambit in December last year, there is not much of a case against the Samajwadi Party leader. The progress of this case shares a grand coincidence with the swinging fortunes of both UPA governments and the warmth (or lack thereof) of Mulayamâs relationship with the ruling Congress.
