Does YSRCP/Jaggu have the right to complain under anti-defection law? Let us recall a few facts: Jaggu/YSRCP had accepted several MLAs from other parties without making them resign to their MLA posts. When the then Dy. Speaker Manohar issued notices under anti-defection law, the notices were questioned by the defector MLAs on the technical grounds of whether Dy. Speaker has such powers in the absence of a regular speaker. They used other tactics too to save their posts but final outcome was that they were declared to have violated the law and therefore disqualified. Given this track record, YSRCP/Jaggu should not have a right to complain under anti-defection law. Should we not demand an amendment to the law to revoke the rights of such people? Also, given that Jaggu hinted at once again going against the letter and spirit of anti-defection law by announcing publicly that he is in touch with TDP MLAs to make them do anti-party activities resulting in the fall of their govt., should not an exemption be granted to TDP from anti-defection law so that they can retaliate and counter the moves of Jaggu? Can't we demand an amendment to the anti-defection law to allow encouraging defections under such circumstances when a known violator of the law (based on his past track record) threatens to destabilize the govt.? Also, shouldn't we demand for an amendment to allow the speaker to issue coercive orders to make Jaggu reveal the names of TDP MLAs who are secretly in touch with him to do anti-party activities such as toppling the govt.? Can't we allow phone tapping etc. to get the names? We should also demand an amendment to the homicide law. If X (a person who was punished for committing murders in the past) threatens to kill Y, Y should be allowed to retaliate by killing X in self-defence.
