Not an issue. Since the new petition receipt notice is with you. But why did the Emp A made your last date as 9th instead of 22? If required, new employer can file amendment to have an early start date for the pending new petition(in your word the petition for transfer) | ||

I am currently with employer A. I got an offer with employer B and they have applied for transfer . I have the receipt notice for the H1b with the employer B. After I got the receipt with employer B , I have put my resignation with Employer A. I gave two weeks notice saying Feb 19 will be my last date with Employer A. I have confirmed with Employer B saying , I shall join them on Feb 22. Now Employer A has processed the resignation and told today (Feb 9) as the last working day. I have checked with Employer B , whether I can join them early. They told me that the H1B petition is filed with Feb 22 as starting date Employer B said , they cannot join me before Feb 22 Will this be an issue , as I am not employed from February 10 to February 19 and will not be having any payroll during this time ? |
