Siloan:This process must be completed by February 12, 2016 under the court order. Since the ICE has just officially initiated it, it should be do-able to achieve it within the time line.

10/03/2015: Very Good News for STEM OPT Rule-Making Compliance Initiative Ever since the STEM OPT EAD rule was struck down by a federal court in August with the court order to vacate the rule unless the DHS (ICE) rectify procedural defects (failure of notice and comment period in the rule making process) by 02/12/2016, the devastated academic and research community and STEM OPT community were very anxious to see that DHS (ICE) would initiate the proposed rule making process as soon as possible. In a tremendous anxiety, STEM OPT community initiated petition process with the White House asking to initiate the rule making process as soon as possible. Within the time limit of the White House petition process, the number of signatures passed 100,000 within the time line and this website was proud to join the effort by setting up petition site at our home page which helped tremendously in achieving 100,000 signatures. Yesterday, October 2, 2015, the USICE submitted the STEM OPT "proposed" rule to the OMB for its review and approval. This is the first step for the required rule-making procedures and steps. Once the OMB approves it, ICE will publish it in the federal register seeking comments within certain period of time. Once ICE receives comments, it will review all the comments and then draft and submit an interim final rule to the OMB again for its review and approval. Once the OMB approves it, the ICE will publish the Interim Final Rule in the federal register again with the effect date notice. Interim Final Rule is a legally binding rule. This process must be completed by February 12, 2016 under the court order. Since the ICE has just officially initiated it, it should be do-able to achieve it within the time line. We extend our congratulation to the research/academic community and STEM OPT stakeholders for this good news |

10/04/2015: Compelling and Irreparable Harm Evidence of This Reporter's TRO Incident 30 Years Back Some of our readers read this reporter's posting of his experience of TRO in a federal district court in about 30 years back and asked some more information about the undocumented immigrant involved. The following is recollection of this reporter for the incident at the time. A young undocumented immigrant lived with a blond hair young U.S. citizen woman. They gave a birth to a beautiful and cute baby. Carrying the baby, two of them were walking on the street, and the undocumented immigrant was arrested by an INS immigration enforcement officer who started the process of deportation without any delays and without immigrant court proceeding. The helpless mother screamed and cried carrying the tiny baby in her arms. The ruthless immigration enforcement officer started to deport the man physically, taking him to the airport to deport him out of the country. The situation was dire and desperate when this reporter was contacted for help. Considering the emergent situation, this reporter had to leave the office and started running on the street to the court house. Mercifully, a clerk of the court allowed this reporter to sit down in a chair and to prepare the emergency TRO motion in handwriting. She then took it to a senior judge of the federal district court and came out asking me to wait. After a while, this reporter was called into the judge's chamber where the judge started to hear this reporter's plea and presentation as a compelling and dire situation that was created by the agency depriving the people of constitutional right of due process. The judge recognized that unless the judge acted quickly, there would be irreparable harm to the alien and the family. The judge then picked up telephone and called the District Director of the local INS office. At the time, there was no separate ICE agency. Immigration law enforcement function was just part of the INS offices. After hearing the details, the judge notified him of TRO decision, but was told on the phone that the alien was already taken out to the airport for deportation on a air plain. The judge ordered him to immediately contract the airport to stop the flight. Soon, we learned that indeed the flight was stopped at the airport and was returned to the terminal to take the alien back. This was clearly dire and compelling situation with potential consequences of irreparable harm to an alien and U.S. citizen family caused by an irresponsible act of an immigration law enforcement officer. This reporter dropped tears because he was totally overwhelmed by the tense moments and overwhelming emotion. A young lawyer without ugly wrinkles all over the face which he now has. Thank you for asking this reporter to walk a memory lane, especially in this melancholic fall season. |
