some one posted in track itt: 1) Rule says "by amending its regulations governing the adjustment of status process". Why will AoS process need amendment if they are not going to touch that part? 2) Rule says "beneficiaries to obtain work authorization". Aren't people on H1B already having work authorization? What is it that I-140 beneficiaries are going to "obtain" now? My answers to the above points: 1) AoS process will be modified to allow I-140 benes after 1 yr of approval to apply for AoS irrespective of PD. 2) It means EAD. You may ask what does "clarify the meaning of portable work auth" mean then?. It means you can take the approved I-140 and change jobs without having to restart PERM & I-140. Because even if AoS is modified you still don't have GC, so while you wait, you can still change jobs. I-140 by itself doesn't give you work auth that's why you need EAD. This also covers the statement "provide relief to workers facing lengthy adjustment delays." Also, after the WH report was released, people attended USCIS conf call and they said EAD after I-140 approval is their highest priority.
