Taking oath and joining government while one's party is in the opposition would be construed as "voluntarily giving up membership of the party." Talasani would be liable for disqualification on these grounds. I think the High Court would disqualify him soon if the speaker doesn't. More likely, the speaker would sense what the High Court is going to do and pre-empt the HC by doing it himself. Also, the disqualification would be effected from the date of defection. This means, he would have to return his salary as MLA received since the day of defection and return salary as minister from six months after defection.
