Sannayi, idi issue. I have a labor which was filed by my old company (consulting company) in 2007. The I140 was denied due to ability to pay. Same company filed another labor+ I140 for me in 2012 which have been approved. I have all the documents with me. I am stuck with PD 2012. I shifted jobs to a client. The PERM has been certified though took 7 months. Any chance of using 2007 priority date for filing this I140 instead of using PD from 2012. ************************************************************ Ron's response: There is no limit as to when you may re-file. They key will be looking at the company's finances before and after your PERM. There is considerable case law for the proposition that an I-140 should not be denied because the company hit a bump in the (financial) road. The case most often cited by the USCIS as authority for their ability to pay decisions is Matter of Sonegawa. If you read that case, you will see that the company did not have the present ability to pay the offered wage. They approved the petition,however, because it was clear that the company would have the ability to pay after the new employee came on board. | ||
