As long as the employer is ok with it ur friend, it should be fine.. employer 140 cancel cheyyakunda retain chesti position open unte he can always go back |

Outside USA one1 year within last 3 years experience undali to qualify for EB1, so aa option ruled out. Ippudu unna employer is willing to refile PERM & I140 and it will take atleast another 8-10 months to get I140 approved. September lo GE management vasthundi so vallu ela deal chestharo idea ledu. Chaala disappoint avthunnadu friend. Blood pettadu to prove & beat the rest of the US colleagues to qualify. Last ki ninna interview kuda ayyindi and did very well and last ki Lawyer nunchi shock lagaa. |

rule of thumb.. as long as the roles and responsibilities dont change more than 50% ish... u can retain the PD... job title piccha lite... But if the roles and responsibilities are changing like programmer to manager... then u have to refile... Chinna companies manage chestayi.. but pedda companies chaala strict untayi... |

So here is the story. My friend has an approved I140 on EB2 with priority date 2011. He has grown very fast and now has an option to take up Manager role. The only reason he got delayed with this promotion was there was no vacancy for this Manager role since 2 years. Unofficially he was performing manager role and now has an opportunity to take this up. If not now, then it may take a longtime for him again. When HR contacted the Lawyers, they suggested that current I140 will not be valid anymore if he takes up this new role within same company. Another problem is that our company is acquired by another Big Company and will complete this deal in September. Now it's GC Vs Manager Please suggest if there is any workaround in this case. He need to update HR with his choice today. Appreciate your time & suggestions |
