Tata was appointed as evironmental consultant for preparation of Envr impact assessment report as per the plan
They will follow all procedures and get MoEF approval for project.. State will support through liaison with center to get approval faster..
CRDA plan by s'pore has given top priority for Green preservation.. There is no need to worry that process can be stalled
Ina MoEF tho issues vasthe Green tribunal ki velthundi case, so sunrise ki mundee kuusi natty vunnai.. State did not even file application yet with MoEF.. Green tribunal em chestedhi MoEF clear cheyyakunda.. GT cheppina cheppakapoyina existing MoEF committees will do their job

Supreme Court has rarely agreed to even hear appeals on the orders and judgements of this tribunal so in a way, it is more powerful than a HC because HC's orders are more often modified/reversed by the SC than those of this tribunal. The reason for that is that this tribunal has both Judicial Member (legal background) as well as Expert Member (Environment and Forests expert) and they only listen to cases in division benches.

Absolutely wrong, this tribunal has enormous powers, in order to enforce its orders, the tribunal can convict the person responsible for violating its orders by conviction unto three years as well as enormous fines.

And it is true that appeal lies only with the Supreme Court of India. In fact, every bench of this tribunal has a current or former High Court Judge as Judicial Member in addition to an Expert Member (who is designated as equivalent to Union Secretary, i.e., Chief Secretary in state). The Chairperson of this tribunal also actively hears many cases by Presiding over the principal bench, he resigned as the judge of SC to join this tribunal as Chairperson.

The Supreme Court today declined to entertain a PIL questioning the decision to develop new capital city of Andhra Pradesh on the southern side of river Krishna near Vijayawada without adequate environment clearances.
“Only at the time of construction activities, environment clearances are required and not before that,” a bench comprising Chief Justice H L Dattu and Justices M Y Eqbal and Arun Mishra said.
“For developing a new capital city, there will be some or the other problem. Here it is about acquiring 30,000 hectares of land. All sorts of problems will be there. Can the Supreme Court say that the capital city will be in this part or that part?” the Bench observed.
The PIL by Andhra Pradesh residents P Srimannarayana and others had raised several questions and their advocate Prashant Bhushan contended that how can the super city be developed without environment impact assessment when it involved 7000 sq km of area.
“It is very difficult for us (to pass direction),” the Bench said, following which Bhushan sought to withdraw the petition with the liberty to approach the National Green Tribunal.
Allowing withdrawal of the PIL, the bench said the petitioners are at liberty to approach an appropriate forum.

This is exactly what I have been saying... Why don't we understand that there is a need to preserve the environment? Akkada capital vaddhu ani cheppatledu evaru... Get proper environmental clearances before building anything annadhi point. Is that wrong?

There is NO clerance necessary for a capital city apriori....please read what HLDattu said in his judgement in the same case....!! Environmental impact is done at the stage of planning the capital which has been done as per the green cover specified in the singapore govt provided plan....

All necessary permissions in place...you further need to understand that green tribunal has no binding authority, it has as much power as human rights commission, its the supreme court that will decide this and the chief justice HL Dattu has already given his opinion....all these central govt committees are a big showofff...nothing will come out of this, it wont even delay the capital building activity....

UPA govt was ready to denotify forest lands for this....this plan is a hell lot better than that....no chance for any adverse remark in this matter, besides Green trbunal ruling is not binding....

Supreme court struck down this case once...if at all green tribunal pokes its nose after environ ministry report (highly unlikely since Javadekar is the environmental minister and a good friend of Bob), supreme court will strike this down again....mch ado about nothing....

The National Green Tribunal has issued notices to the Ministry of Forests and Environment, Andhra Pradesh government and the Andhra Pradesh Capital Region Development Authority (APCRDA) for undertaking development works for the new capital city on the Krishna River bank without conducting appropriate environmental impact assessment.

The Tribunal has directed the Union environment and Forests Ministry to constitute an expert committee to analyse the environmental and social impact for developing the new capital city. It has also directed the Andhra Pradesh government and the APCRDA to not undertake any development activity including urbanisation or infrastructure development on river floodplain, wetlands and fertile agricultural lands.

The AP government has been further directed to examine the feasibility of large-scale urbanisation and infrastructure development on the areas identified for formation of the capital city and to propose alternatives which could lead to minimum devastation of natural resources.

The intervention follows concerns regarding large-scale development activities planned for the new capital over one lakh hectares of land acquired by the A.P. government.

An expert committee set up by the Centre had earlier raised issues of acquisition of fertile agricultural land, high water table of the region, vulnerable soil type and the flood-prone nature of the region to suggest that the nature of development planned in this region may not be appropriate for it.

The NGT’s order came after two individuals Pandalaneni Srimannarayana from Vijayawada and Anthati Kamalakar from Nellore moved the Tribunal after the Supreme Court heard their petition on March 20 and asked them to withdraw the petition and approach an appropriate agency to raise the matter.

The appellants were concerned that the development of the new capital in the present manner may adversely impact the livelihood of residents and environment of the region overall.
