Thokkalo Babai... Who said the word "extension" in my reply. I have asked to FILE a NEW petition(again, there is nothing called "Transger" "Extension" etc exclusively in the H1B petitions. ALWAYS its a H1B petition. You would choose an option for "Extension" in the petition, if the H1B guy is already with your company on the same status. If not, its ALWAYS a new H1 Petition. Only the diff is wither he comes under QUOTA for that year OR not in the quota(for this quota, the existing H1B approval notice would be attached. Having said that, OP babai can have ANY NUMBER of employers apply for a new H1B immediately now in Non-Quota category(by attaching a paperwork which proves that he was selected in this year H1B quota OR with a cover letter saying that he was selected in the lottery and needs to file a new petition). Worst case would be they may ask for the current H1B approval copy in RFE at a later time(if the USICS officer is on nuts and of poor knowledge about the USICS legal stuff). All this guy needs to do is to supply the approved H1B from OR H1B receipt notice of the first filing employer(by that time he would get a receipt notice). So, It is possible. If someone proves that its not possible, I will file for him for a fee and get it done.. :-) | ||

asalu first h1b active kaledu... so he is technically in F1 status or not in USA. alantappudu how can he file for H1B extension (or transfer??).. he should be in H1b Status to file for a extension. There is nothing called H1 TRANSFER in this world. We use this term for convenience only. The new company CAN apply (its not a transfer, its a new petition but not under quota) with the approved petition copy. (no need to wait till October). If he gets approve, he can jump. If not also the old company petition would continue to have its own ride independently. Rule: You can have one million companies file your H1 Petition, no issue.(its like you are having multiple job offers and you can choose to work for which ever is of your choice) | ||

H1 transfer ki he needs to show atleast one paystub to prove that he is currently working under H1B. Min October 15th varaku aa paystub undadu. until then any H1 application is considered as a new applicaiton and go under quota. immi lawyer emanna losugulu vadi try cheyyochemo, but naku telisi impossible! | ||

Ma tammudiki oka full time opportunity ochindi. He also applied for H1 and it got picked too. He is waiting for approval. He filed the application through one employer. OCT lo h1 start ipoddi. Ye time lo vere company ki move kavocha. H1 transfer asalu possible aah without working even for a single month with his H1B employer? Please advice.... |
