In the matter of bail, judges have some discretion. SC three judge bench headed by CJI decided to expedite the appeal to rocket speed and grant temporary bail on medical grounds. Karnataka HC lo single judge bench ki appeal expedite chesey power ledu. So he may have decided to deny bail. | ||

On the face of it, it may look like that but consider precedents. Many including Haryana Ex-CM OP Chautala who was convicted for 10 years (much bigger than Jaya's 4 years) were granted bail on medical grounds. Jaya is a senior citizen and has been a diabetic for quite some time now (not some illness that suddenly appeared after she got convicted). What must be noted is that the SC actually gave a very big punch to Jaya by ordering them to file all appeal related documents in 2 months (they said they won't give even one additional day) and then the SC will direct Karnataka HC to dispose the appeal within 3 months it seems! I can't think of any instance when the HC was asked to dispose off an appeal within just 3 months! Usually HC appeal process takes quite a few years. In this case, the evidence seems to be solid. Overruling the judgement of Judge Michael Decunha is unlikely. Jaya would have hoped to delay the appeal as much as possible but SC's directive to finish in 3 months would have come as a big blow. Once HC disposes the appeal by dismissing it, Jaya may have to go back to jail and bail would be much harder then because at that time it won't be bail by suspension of trial court order, it would be against the High Court itself! SC appeal option would still be there but sometimes SC won't grant the privilege of appeal. Appeal is a right only unto HC. SC appeal is not a right. It's a privilege that may or may not be granted by the SC. Even if SC grants the appeal, they may not immediately grant bail and instead ask her to fight the appeal by staying in jail. | ||

Nothing to do with where they get their law degree from. Most of the judges of the SC have been selected from amongst the judges of various High Courts in our country. Some have been selected from SC or HC practicing senior advocates. The selection is done by a collegium of senior most 5 SC judges including CJI. High Court judges are selected either from SC/HC bar council practicing advocates or from District and Sessions Judges. The names are shortlisted by HC collegium and final selection is done by SC collegium of senior most 3 judges including CJI. The collegium system may soon be changed because of the new National Judicial Appointments Commission bill that was passed by LS and RS and is awaiting ratification by 50% states and President's assent. | ||

While Supreme Court's soft corner for a criminal is puzzling given that the case has dragged on for 18 years, the supreme court also said that Jaya has to file all documents in 2 months, and that high court should finalize a judgement in 3 months, which implies that the case would cross the highcourt level in 5 months. Jaya cannot be the CM till the case is decided, she has to be under house arrest. I hope that Supreme court lays down the rule of 1year maximum for trial courts, 6 months maximum for highcourts and 3 months maximum for Supreme Court on all Corruption cases.
