but because of perm filed by B approved first (even though PD is in 2014)Is A's perm (PD in 2013) get cancelled? can we have 2 perms applied and those 2 are approved?then choose which PD you want? or if the Perm filed latest approved, the perm filed earlier will be cancelled? | ||

Once PERM is approved, you have 6 months time to file for I-140. Based on this you need to make decision. In you case scenario, since two companies filed two perms, technically you can have two different PD's. if your company A ties your previous PD(i.e. company B PD)then Company A PD will overwrite company B PD, and you will have only one PD. PD waste enduku aithadi bhayya... u can always have the same PD if u have same roles and responsibility kada.. may b u will have re-apply but u wont lose the date ani anukuntunna.. | ||

Employer A filed perm in July 2013 - Got Audit and still in audit meanwhile got H1B transferred to sister company of A i.e Employer B, and they filed PERM with Company B in AUG 2014. looking the pace of perm approvals chances are there that B's Perm approved earlier than A, now 1. PERM Filed by A can be approved even though perm filed by B is approved earlier? is there any policy that the previous date get nullified? 2. Can I wait until A's perm approved and apply 140 under A and once approved use that date for B? 3. now, A is going to be completely merging with B, what happens? konchem idea ivvandi |
