Sathasivam as the Governor of Kerala, and his reported acceptance of the position, has received criticism from the legal fraternity.While Supreme Court judges and even chief justices of high courts have been appointed governors in the past, the move comes in for special criticism as many point out that it is the CJI who administers the oath of office to the President. Critics ask: Is it right for a person who held such an office to become a governor, as the governor technically reports to the President?In July this year, when Justice P. Sathasivam's name had first come up as a possible candidate as the governor for Karnataka, the All India Bar Association wrote to Prime Minister Narendra Modi. "The appointment of Justice P Sathasivam as Governor of Karnataka will be a deviation from the cherished principles enshrined in the Constitution," Adish C Aggarwala, Chairman, AIBA wrote to the PM.Aggarwala pointed out that the former Supreme Court Chief Justice had given a ruling in 2013 quashing an FIR against the present BJP president Amit Shah. "In close succession to the said decision, and soon after retirement, the grant of the position is bound to be viewed with suspicion.""It would be neither in the interest of the government nor of Justice Sathasivam that he is considered for the post. Instead, the Government could consider his candidature for the position of Lokpal," he had said. No Signature |
