H4-H1 perfectly valid But shud wait till u get approval. No need to wait till oct. Ur wife is cap exempted as she had a valid H1 in last 6 years. If ur wife H1 is expired and if its more than 6 years , then they will file under cap. Confirm with the attorney bhayya.. employers kakkurthi na konde gallu untaaru so they will push for working once approved (as opposed to waiting for october).. when i was working with Apple, naa colleage wife same limbo la unde.. after talking to 3-4 attorneys they decided to wait until october.. | ||

Thanks Suyodhan/Sesani/Archiect brothers... Valid H1 ledu...That was cancelled upon H4 approval... So, ippudu attorney ni kanukuntamu whether after COS is approved, she can from October or can start work immediately...My Wife's employer who is filing H1 for her said she can start work after approval and they have done similar cases before..We will get a confirmation once again... | ||

How can u transfer bhayya? She is on H4 and not on H1b to transfer.. H1b is void once H4 is approved. Company has to file a new application (which doesnt fall under Quota). As to when she can start there are 2 theories on this. - Some attorneys say she can start working only from October - Some attorneys say she can start working once H1b is approved bcoz she was on H1 before My friends wife had same situation but she ended up starting only from october. AFAIK she cannot work on receipt because she will still be on H4 until approved and this is illegal.. (again now vs october check with attorney) | ||

Jan 2014 - Resigned - H1B - Closed. --> Correct H-4 Visa is Active now, right?? (In my opinion, one cannot have two Visa's at same time) - Check legal advice too --> Correct. We are applying for COS to H1-B now.. If she is still in India: apply H1B transfer, H-4 to H1B should be new application in next April 2015. --> She is in US along with me now on H4 but will be exempt from quota so we were told only a COS + visa transfer would do and need not wait until next year... | ||

My spouse had a H-1B before our marriage which was valid until September 2015. But after marriage, her employer could not find opportunities in US and she was sent back to offshore. After couple of months in Jan 2014, she resigned and joined me on a H-4 visa. But now, she got a employer who is doing a H1-B visa transfer for her under premium processing. Please let me know if she can join upon getting the receipt# or she had to wait till it gets approved? For H-1 to H-1 transfers. receipt notice vasthey chalu antaru kada..does this hold true for H-4 to H-1 transfer as well? TIA |
