damn...I shud have just kept quiet....my bad.....not aware of this new automated process of I-94...... it seems like paper I-94 issuance is obsolete....although the concept of I-94 still exists......so it is better the implications around it is well understood.......with the new automated process...... anyways, better I shut up as I am not totally aware of the new changes....... CIS stopped issuing I-94s when you enter the US - its an old concept now. when you enter back into the US, dont talk about the new H1. if its approved during your 6 week stay in india, have the approval 797 copy with you. mostly, they dont care so long as you have a valid h1b stamp - at worst they may ask you what you are gonna do in 3 months when it expires. show them your new approved or in process application. I will stir the smooth sands of monotony |

my second post is in the scenario H1-B is still in process and not approved when your are coming back.........not sure that application gets invalidated when u have a new I-94.......while the application was based on old I-94....... |

I-94 that comes with new H1-B is not valid once u move out of the country after applying the H1-B.......infact H1-B application is based on the old I-94.......so I am not even sure how it would impact the application, if you come in with new I-94.......while application is still in process...... may be you need to inform the USCIS about the new I-94..... I think a good idea is to apply after coming back....... only moving to Canada/Mexico where I-94 issuance is not mandatory is safe while application is in process.......as far as I know....... |

even if same client.........issue is with I-94 expiry.........if you enter with old H1-B...........I-94 expiry date will be based on that, if you present old H1-B papers...............although the new H1-B got approved, ur I-94 will not be covering the new period.............u may need to deal with the I-94 adjustment later.......... if new H1-B gets approved, get those papers posted to India before you travel.......with the stamp in passport, u can come in.........with new H1-B papers, your I-94 will have the appropriate date...... only issue with this is.........if your H1-B gets approved a few days before ur travel.....and u dont recieve the papers on time before u travel back....... or else, in July u can travel to Canada/Mexico using 30-day validation period, which doesnt require new stamping..........get the proper date on I-94 and things should be fine........ |

I am sure this question was asked a 100 times before, but my situation is slightly different, so please read. My current H1B expires on July 15 2014. I am thinking of taking a 6 week vacation some time Mid Feb.
