Article 371-D need not be amended for creating Telangana state. However, Parliament could in the law proposed under Article 3 & 4 choose to either make textual alterations to Article 371-D for incorporating a reference to the State of Telangana or leave the existing Article 371-D in its present form. If they want to make textual alteration, In view of Article 4(2) and the interpretation given thereto by the judgements of the Supreme Court in Babulal Parate v. State of Bombay, reported in (1960)1 SCR 605, and Mullaperiyar Environmental Protection Forum v. Union of India, reported in (2006)3 SCC 643, the amendments or alterations, if any proposed to be done in Article 371-D, would not require to follow the amended provisions of Article 368. As a fact, nearly 159 alterations have been made without resorting to the procedure under Article 368 for amending the Constitution, including for changing reference to the state name from âOrissaâ to âOdishaâ and âUttaranchalâ to âUttarakhandâ. | ||
