annai....wify was on l2....when she went to india husband changed to h1 and applied h1 for wife tooo....he got 3 years...but wify got 1 year...so wify stamping ki vellakundaaa....came on h4...thinking of COS | ||

Employer has to refile her H1 using COS of H4 to H1 for COS, they have to get a job, without which H1 cannot be applied Last and Most important Employer can file her H1 any time in next 1 year (this could be 3 years too check with attorney) whenever she gets the job, this H1 will not be counted in the quota, | ||

Need serious inputs on my friends case. Friends wify was on L2 - Went to india - In the mean time hubby applied for H1 last year quota - Got the approval for 1 Year - Exp OCT 2013. But, wify came from india on H4 - ikkadiki vachi change of status cheddam anukunnaru, since it was just 1 yr validity. Now the case; 1) Wify has yet to find job. 2) Employer is not filing for extension stating the below two reasons. Even though the petition will expire, i will file the extension using the same petition once she gets the job - Is this possible, can we file the extentions even with the expired petition. Lawyer ni adigite, enduku idantaaa already wify ki ssn vundi kada....illegal ga panichesukondi ani vuchitha salaha ichaadu anta....is there any legal issues in this... Please provide your valuable inputs |
