Mav, normal cases lo visa-expiry mundhu 3,4 days return vacchina vaalu unnaru. they showed thier I797 (which is current and running) and they got I94 upto i797 end-date. Nuvvu cheppe case lo, 1 factor vundhi: the I797 is of future date , validity and ends in future date. when u return on sept 26, ur new i797 is valid from oct 1 to 2013.. and we dont know if officer will take action on document which is not in started its validity. oher scenario: when you go out of status, due to employment change, you get an immedeiate h1 with validity from current date but without i94. in that case if you have valid visa stamping, you can go out and return back immd and show the current I797 which is already in-date but needs a status-override by POE | ||

OT, once a person go and comes back thru POE that will OVERRIDE your current/past statuses. Uscis I94 is useful as long as you dont come thru POE. Once you go and come back via POE, whatever POE is giving you (i94) that is Latest (final). | ||

then also no problem for her travel. only thing you should keep in mind is she goes now, you get h1,h4 extensions here(NY Home) and then she returns back before september 30. in that case, she will be given I94 upto sept 30 only at POE and since she did not receive I94 thru USCIS, she has to go back. bottomline: consulate visit is a required even if you escape now, future lo it hangs on | ||

OT. anyway you are prepared for visa interview and return only after september. in that case, it really doesnt matter whether you get a I94 or not. even if you wait to get I-94 now and then leave (by surrendering the latest I94) usa, anyway you have to get STAMP and will be getting an I-94 at POE. Your EXTENSION of H1b is not based on whether you are in USA or temporarily gone to india, but based on the Strong Documentation provided by employer. getting a I94 is useful only for those, who has expired visas and not planning to travel next 1 or 2 years. Since anyway you are going out and coming back, you neednot worry about I94 given or not with extension | ||

If you are willing to attend for VISA interview, then it doesnt matter if you eave the country while your app is pending. I suggest that your company HR Manager/Attorney write a letter to the respective USCIS Service abt the situation. | ||

If you leave the country while your I-129/I-539 applications are still pending USCIS determibes that you abandoned your status. They will be both approved and denied, Its funny. They Approve the application, but they will deny the Extension of status. Antey New H-1B with I-94 raadu. | ||
