If the H1 is not approved...he is fine on OPT (not out of status). He can join the company as OPT. If the H1 is approved, he can have the lawyer call the company and demand(threaten with DHS etc) the H1 transfer. In this case OPT is expired but he has a valid H1. Either way i think he is covered. Lesson learnt - Always ask for the H1 approval notice before taking any job. Its a must. | ||

He is not working for the intern firm since he got his H1 which is around a month.. apparently another student who got H1 from the same consultant, went and found a contract position for himself, but this consultant started quoting huge hourly rate for this inexperienced guy and screwed the contract.. looks like this desi consultant is more of a moron than a fraud.. | ||

ask him to threaten the desi emplyer that he is going to complain to the dhs labor that he is not paying him.ur friend is already in a wrong status if he is working with the intern firm and he is on h1 payroll from oct 1 Nenu prati tube ki reply ivvanu..kiki | ||

if he has valid opt,then it doesnt matter if somebody already applied for his h1...he can ask this interning company to file a fresh h1 for him....a single person can hold multiple H1's at any point in time...the only problem comes if his opt was done...then he will be only on H1 status and he needs to get his H1 transferred....best thing to do in such cases is contact some immigration attorney,he will server a legal notice to the desi employer playing games that he is nt paying salary to my client and he will cc it to ins with a fresh H1 application for ur friend stating that employer is not paying salary and my client needs to get transferred to the folowing new company.... | ||

All need your advice or experiences I have a friend who just finished his Masters in US, he worked as a intern in a small software company on his OPT for couple of months.. in the meantime listening to advice of his friends he approached a local desi consultant for H1. The desi consultant applied for his H1 and looks like his H1 got approved.. which automatically puts this poor young guy out of OPT His desi consultant just told him he got his H1 approved and gave him EAC number to check on web but did not give my friend original or copy of H1 approval. This consultant is not finding jobs or placing these students but wants the students to find jobs for themselves. Now my friend got a full-time offer from the company he was interning. Since it is just one month of H1 - he was ready pay his desi consultant the H1 cost the consultant incurred from his own pocket. First the desi consultant asked my friend to show the offer letter from software company as proof which this guy went and showed. From then for a week this consultant is making my friend go round and round by saying different things but not giving him his H1 approval info. The attorney of the software company which offered by friend the job thinks this is fishy and illegal and also says may be this desi consultant never got the H1 approval for my friend... what are the options for my friend now.. he asked me for advice and I dont know myself |
