if h4 is not filed I guess does not mean out of status, since h1 is in status h4 is also in status but to avoid complications it’s best to renew h4 as well. I was told differently. suppose: - H1B is approved for 3 years and so is H4. - primary guy changed employer after 1 year and applied for H1B Transfer. It approved for 3 more years - Please note H4 is not applied yet and I was told - H4 is safe for 2 years and aft the end of 3 years from the first H1B Start date, she can find for H4 extension/transfer - or whatever u call But at the end of 2 years from day 1 - if the H1B guy is let go and further H1B is NOT approved, H4 is also invalid though primary had H1B for 2 more years and H4 for one more year. u can not renew h4 while u r in India, imagine first time coming to USA. H4, L2 ivi kuda petition specific untaya? I was under the impression that H4 doesn't need to be re-filed and they just have to present the new i-797 on arrival. Is it not correct? | ||

H1B transferred/approved to a different company and the old company filed for revocation of old h1b. what would be the status of h4? If the h4 was previously approved based on old h1b |
