I think you can have two valid visas on your passport, but you can enter only on your latest immigration status. For example, I entered here on B1/B2 visa first and next year on L1 and I'm still on this status. Now I don't think I can use B1/B2 for entry unless L1 is invalid. Otherwise, many people would have entered on B1/B2 or H4 when there were POE issues. | ||

You get new i-94 with i-797 approval when it is approved while you're in USA. So your i-94 visa associated with H4 shouldn't be valid anymore as your status changed. I believe you need to get H4 stamping done when you go to India. | ||

Yes bro, u can go out and enter the country on H4 based on the previous stamping u got...when you enter the country again, you will be on H4 status...a person can hold any number of visas and can chose to enter on what visa they want...for example, I had both H1 and H4 stamps valid at the same time on my passport...even in consulate, they don't cancel the other visa while granting the second one...only same class of visa's are cancelled, not across visa categories... | ||

In your approved petition they will mention I94 details , in PoE it will show your new H1 status not H4. So Ideally you have to apply for switch to H4 again once thats approved go to India and get stamped. | ||

It is somewhat of a pickle. You can only be on one visa status at any given time. When you say both will be valid, it is more a pseudo validation. Because you can potentially switch visa categories based on what you use to reenter the country each time. As you said, an immigration attorney is the best bet to explain all of this. | ||

All you need to do is to file for a H4 Petition using your spouse’s approved H1B(I-797 notice of approval). This can be done by yourself, you dont need it to be done by either your H1 employer OR your husband’s H1 employer. Generally, for most of the cases, Your spouse’s H1 employer does this as a courtesy. Please contact your spouse’s H1 employer to get your H4 filed. (Again, your husband’s employer or any other doesnt hold your H4, its all yours.
