In order to continue your stay you need to have the valid I-94 attached to i797. If not they will provide it after stamping when you arrive Mine was delayed by the attorney and he filed after my I-94 expiry like 7-10 days gap, he filed some form and contacted them. I got my i797 approved with i94 again. So I was good in this case | ||

how did he do it? ithandhi normal case no gaps..but y they did not attach i-94 to 797 anedi teliyatla. lawyer said he will check on that as well | ||

Oh man. He is illegally staying from previous amendment itself. He needs to get out of the country ASAP. The rule book says like this. If the i94 is attached then they are continuing your stay based on your previous i797. If not you need to go out and get stamped and get back. If he has issues ask him to consult some other attorney. I was through this once, fortunately my attorney was able to get my i94 attached to the i797 as it was his mistake in delaying | ||

not my case after prev amendmendment seems like i-94 was not attached to i-797. i-797 still valid but no i-94 attached. so they missed that. now since h1 is due for extension they filed for extension and found this after filing, when they tried to make it premium | ||

In this case you are good to stay... but check once your i797 is approved, if they gave your i94 attached. If attached you are good. If not immediately leave and come back stamped | ||

Who’s mistake was it? If attorney delayed it he will have file a letter... did not remember the name of the form. Else if your employer delayed then it’s illegal.. you need to go out and come back with visa stamped | ||

i-94 expired, but h1b extension is in processing? only problem is h1b extension is applied after the expiry of i-94. ok to wait until h1b extension goes through and then go for stamping? |
